Crushing plant rentals: product applications

The lessor must meet the following conditions:

• The rental crushing plant must be equipped with all the requirements as included in Article 7.2.1 of the EHR (Uniform Regulation for Recycled Aggregates), including the presence of a pre- and post-screening system, a web-based information system with GPS, a magnetic separator, …;
• The rental crushing plant may not be rented out if the lessee does not have a valid environmental permit for the mechanical treatment of waste materials;
• The lessor has a registration agreement with COPRO to work in accordance with the established procedure for rental crushing plants (F-11H-02 – AFD Rental Crushing Plants);
• The lessor will draw up a lessee/lessor agreement signed by both parties (F-11H-01 - End-of-Waste Agreement for Rental Crushing Plants) and submit this to COPRO together with the valid environmental permit;
• The lessor must always comply with this procedure for every crushing location in Flanders with regard to the rental of a crushing plant for the production of recycled aggregates. If non-compliance with the conditions is discovered, the competent authorities will be informed. The lessor can be removed from the list of registered crushing plant rental firms by COPRO.

The lessee must meet the following conditions:

• The lessee has the required environmental permit for the mechanical treatment of waste materials;
• The lessee provides the lessor with complete and correct information for the preparation of the lessee/lessor agreement (F-11H-01 - End-of-Waste Agreement for Rental Crushing Plants);
• The lessee is responsible for weighing the recycled aggregates produced;
• The lessee is responsible for the quality of the recycled aggregates (environmental hygiene, structural properties and asbestos) and acknowledges that the lessee/lessor agreement (F-11H-01 - End-of-Waste Agreement for Rental Crushing Plants) applies as a contract with COPRO for the performance of the necessary inspections in the context of an application for an ad hoc raw material declaration. At the end of the crushing activity, the lessee must notify COPRO to carry out all required sampling (structural, environmental hygiene and asbestos related) per product at a frequency of 1/1000 tonnes (sieved sand) and 1/2000 tonnes (crushed products). The lessee provides staff for this purpose;
• The lessee shall bear all costs for the inspections (COPRO TAR PKRL), including sampling, additional costs and the application for the ad hoc raw material declaration. The associated tests in a recognised laboratory will be invoiced directly to the lessee by the laboratory;
• The lessee agrees that COPRO can request the raw material declaration on the OVAM website via the Web Portal (https://services.ovam.be/sso/pages/login.xhtml) for the relevant products on behalf of the lessee;
• The lessee cannot use the recycled aggregates on site until all results are known and declared compliant by OVAM via the raw material declaration.
• The lessee is aware that removing recycled aggregates is not permitted. Only 100% on-site application of recycled aggregates is permitted in the OVAM raw material declaration. If not everything can be reused on site, the surplus must be taken to a certified permanent location for recycled aggregates as waste. Furthermore, the rubble present on the construction and demolition site may only come from the above-mentioned construction site; Supply from other origins is not permitted by law. If non-compliance with the conditions is discovered, the competent authorities will be informed. The aggregates produced will be considered waste and must be removed in their entirety, with proof of disposal slips, to a certified permanent site.

What does COPRO do?

• COPRO assigns the lessor a unique identification number and ensures that it is visible on the website;
• After contact by the lessee, COPRO will schedule an appointment for the sample collection in mutual consultation. COPRO will have access to the crushing site for this purpose from the moment this agreement, signed by both parties, is received until all recycled aggregates have been processed;
• COPRO ensures that sampling is carried out in accordance with the applicable standards and CMAs (Compendia for sampling and analysis of waste and soil). The sampling equipment (sufficiently sturdy bags, buckets, jars,…) is provided by COPRO and ensures that the samples reach the laboratory designated by the lessee, together with the accompanying sampling reports and test requests;
• Upon receipt, COPRO processes and evaluates the test results in accordance with the technical structural requirements (PTV 406) and in terms of environmental hygiene in accordance with VLAREMA (decree of the Flemish Government establishing the Flemish regulations on the sustainable management of material cycles and waste). In the case of non-compliant results, this is reported to the lessee and it can forward its corrective actions (re-run the procedure, disposal, etc, ...).
• On the OVAM website via the Web Portal for raw material declarations (https://services.ovam.be/sso/pages/login.xhtml), COPRO will request the raw material declaration for the relevant products on behalf of the lessee and forward it to the lessee after delivery by OVAM.

The procedure for crushing at a recognised fixed location is already included in the existing BENOR TRA 10 regulations of COPRO. This specifically means that:

• the lessor ensures that its crushing plant is equipped with all the requirements as stated in Art. 7.2.1 of the OVAM Uniform Regulation (VITO-compatible GPS installation on every crusher that is rented, pre- and post-sieving, magnetic separator, possible wind sifter, …);
• the lessee (= fixed location) reports to COPRO that a rental crushing plant (replacement or demo) will be deployed for a certain period and that it is responsible for internal self-control;
• COPRO will carry out an inspection to check the quality of the recycled aggregates that were produced using a rental crushing plant.
